Case against Honey Rose will not be taken to Supreme Court

The case against locum optometrist Honey Rose, who was acquitted of the gross negligence manslaughter of eight-year-old Vincent Barker in July, will not be taken to the Supreme Court.

The acquittal will now stand after a panel of judges headed up by Sir Brian Leveson, refused to send the case to the country's most senior judiciary. The prosecution had applied to take the case to the Supreme Court, claiming the law on gross negligence manslaughter was ‘not satisfactorily clear’ and needed to be considered by leading judges.

The application was turned down in a hearing lasting less than a minute, at the Court of Appeal and marks the end of criminal proceedings against Rose, who remains suspended by the General Optical Council.
