Bausch & Lomb has filed a lawsuit in the US against Ocular Sciences for infringement of the patent for its toric contact lenses to correct astigmatism.
The company claims Ocular Sciences' Biomedics toric soft contact lens infringes its US Patent No 6,113,236 for the Bausch & Lomb SofLens66 Toric lens.
Corporate vice-president Angela Panzarella issued a statement claiming Bausch & Lomb had 'repeatedly' asked OSI to provide evidence that it did not infringe the patent or to negotiate a licence agreement.
'Since OSI did not provide us with the requested information, we had no choice but to file the lawsuit today to protect our patent rights,' she added.
