OO cleared of misconduct

An optometrist alleged to have told her employer that her brother was a qualified dispensing optician has been cleared by a GOC fitness to practise committee.

Fatma Jagani was alleged to have told her manager that her brother, Mahmood Jagani, was a qualified DO in September 2009 and that she helped create a false CV for him in November 2009.

The committee heard evidence from Sharbdeep Gill, store manager of the Brent Cross Vision Express branch at the time. Gill said he had interviewed Mahmood Jagani and that he had been given a CV by the registrant, but could not provide documentation to prove either claim.

In the registrant's evidence, she said she recommended her brother for a position after Gill asked if staff knew of any suitable persons. Jagani said she made it clear that while her brother was a qualified DO, he did not have the necessary CET points and was not registered. She added she believed at the time that her brother would still be able to refer to himself as a dispensing optician. The committee said it was quick to point out this was plainly wrong in law.

The committee said the registrant did not knowingly mislead Gill and played no part in the creation of the CV.
