Lenscrafters patient files class action lawsuit against parent company Luxottica

A Lenscrafters patient in New Jersey has filed a class action lawsuit against its parent company Luxottica after he was refused his papillary distance measurements.

Blane Friest has filed a complaint which cited violations of the New Jersey Consumer Fraud Act, Truth in Consumer Contract Warranty and Notice Act and the New Jersey Antitrust Act.

A trial by jury has been requested by Friest, who seeks certification of the putative class; trebled compensatory and consequential damages and legal fees.

Luxottica has filed to move the case to the US District Court for the District of New Jersey on the grounds that the proposed class has more than 100 persons and that the amount at stake in controversy exceeds $5m.
