Alan Murray admitted to errors. At the time he submitted the incorrect GOS forms he was unaware that these forms had been prepared incorrectly. He repaid an agreed sum of money to the NHS in 2007. There was neither dishonesty nor any allegation that he had undertaken any criminal activity.

As reported in Optician on May 28 2009 the GOC noted that the inappropriate claims were not fraudulent. The fitness to practise hearing was not invited to consider any allegations of criminal intent and noted there was no concern for patients' safety. Optician is happy to set the record straight and regrets any embarrassment caused.
