‘Substantial damages’ will be paid after optom erroneously featured in a TV show

A Staffordshire optometrist will be paid ‘substantial damages’ by Channel 5 after he was erroneously featured in an episode of the TV show: Can’t Pay We’ll Take it Away.

A report in the Daily Mail said High Court enforcement agents entered the Stone practice, along with a film crew, with a writ from an equipment supplier, threatening to seize goods. But Brian Hitchin did not owe the money and asked the film crew to leave. Footage taken on the Agents’ bodycams, which Hitchin was unaware of, was later used in the TV programme.

The court agreed that Hitchin’s privacy had been invaded and the event had caused distress. Channel 5 will pay damages and costs, will not repeat the episode or make it available on the internet.
