According to a report in the US journal Rochester Democrat and Chronicle, Ace American Insurance and IIinois Union, have filed a countersuit denying liability to cover claims against B&L or help in the company's defence.

Lawyers acting on behalf of the insurers claim any injuries were not 'accidents'.
