A New York appeals court judge has given Johnson & Johnson Vision Care permission to claim damages from its rival CIBA Vision over false advertising comparing the two firms’ products.
The damages claim is based on profits earned by CIBA Vision from the sale of the O2Optix contact lenses – since renamed AirOptix in the UK – it advertised.
Harold Weinberger, a partner in the law firm Kramer Levin Naftalis & Frankel which acted for Johnson & Johnson, told Optician he was unable to reveal the level of damages claimed because it was based on confidential CIBA Vision documents not made public.
