A dispensing optician cautioned for the offence of common assault has been found not guilty of misconduct by a GOC fitness to practise committee.
Nuria Soto Leon had been accused of misconduct for failing to declare a police caution received in February 2008 on her application for retention 2008/9.
The committee was satisfied that Leon was in a state of shock as a result of attending a police station and accepting a caution. It also accepted that Leon was in shock from police attending the Tesco stores where she was working on unrelated matters almost every day for the next seven weeks. The committee was satisfied that Leon's completion of the form had been influenced by statements by the police and Tesco that she did not have a criminal conviction.
