Insight takes on Specsavers

Dublin practice group Insight Opticians has taken Specsavers Opticians to court over a '2 for 1' newspaper leaflet headed 'Insight' with a sub head 'Stylish looks for Winter' that appeared in the Herald in early February.

The independent optician took immediate action to get an injunction and on February 10 Judge Laffoy of Dublin's High Court issued an Interim Injunction against Specsavers.

This restrained it from carrying on or purporting to carry on business, advertising, mounting a sales campaign or promoting its services 'under the name "Insight" or under any similar name likely to mislead or deceive the public into belief that the defendant is the same company as or is in any way connected with the Plaintiff company...'

The case was adjourned until mid February, and prior to being heard was settled on the 'basis of a permanent undertaking by the defendants in terms of the injunction as above'. The proceedings were struck out and the defendants made a contribution towards costs.

Speaking about the case, optometrist Niall McCrudden, a partner of Insight Opticians said, 'When it appeared in the paper, people thought it was something associated with us.

'It was a nationwide campaign, but we have a Specsavers two doors away in Omni Park Shopping Centre at Santry and they should have realised that the Insight heading, standing on its own, was virtually identical to our logo. I don't do two for one.'
