Following Asda's claim of victory in a legal battle with Specsavers (News 06.08.10), the multiple has also declared it was pleased with the outcome of the case against Asda for trademark infringement in a marketing promotion last autumn (News 30.10.09).
The multiple took legal action over the campaign which saw the slogans 'Be a real Spec Saver at Asda' and 'Spec Savings at Asda' used in Asda practices and on the company's website and Twitter account and a new Asda Opticians logo featuring overlapping ellipses.
Specsavers' global marketing director, Richard Holmes, commented: 'We are delighted that it has been clearly and unequivocally established by the judge that Asda cannot use the term "Be a real Spec Saver at Asda".'
However, the judge presiding over the case at the Royal Courts of Justice, Justice Mann said that Asda had no intention to copy Specsavers' logo and could continue to use the slogan 'Spec Savings at Asda'.
